DEFINITIONS
The following terms and conditions form a binding agreement between the Client and Tutor World Education Ltd (‘Tutor World’).
The use of our services indicates the acceptance of the following terms and conditions and the Client’s agreement to be bound by them. The terms and conditions are deemed to be accepted in whole by the Client when the Client first arranges a session by telephone/email/Facebook/Tutor World website/any other form of communication. For our online learning centre, the terms and conditions are accepted once the Client pays for access or communicates their intention to use the centre, whichever comes first
1. FEES AND PAYMENT
1.1 The Client agrees to pay the Agreed Hourly Rate for sessions.
1.2 The Client will pay for each session in full prior to the lesson via cash, cheque or online transfer.
1.3 Sessions are non-refundable.
1.4 If the Client is late for a session, the Tutor is not obligated to work beyond the scheduled end time and the session will be charged at the Agreed Hourly Rate. If a Tutor is late for a session, there will be an agreed upon ‘mutual make-up’ of the time lost in another session.
1.5 If the Client chooses to terminate a session early, the session will be charged at the agreed upon price. For example, if a Client terminates a two-hour session after one hour, they will be charged for the full two-hours.
2. CANCELLATION POLICY
2.1 Clients should be aware that there is considerable preparation involved before each session (including, but not limited to, resources such as books, worksheets, practise papers and cost of rent) in addition to travel time and cost to the Tutor.
Clients may always cancel a session more than twenty-four (24) hours in advance of the designated start time. Cancellations made more than twenty-four hours in advance will incur no penalty
2.2. Cancellations made less than twenty-four hours in advance of the designated start time will be considered “late cancellations.” In the event of a late cancellation, Tutor World will charge the Client half price of one session. There is the possibility of rescheduling the session but only at Tutor World’s discretion. If the Client would like to reschedule the session, the Client must contact Tutor World.
2.3 If the Client fails to attend a lesson and gives no notice, the Client will be charged the full lesson fee.
Tutor World recognises the existence of extenuating circumstances such as emergency illness or any other emergency situation.
2.4 If a session falls on a religious holiday that either the Tutor or the Client wishes to observe, then an alternative session can be arranged. The Client must inform Tutor World of this prior to the holiday.
2. 5 The Client must behave in a respectful and appropriate manner at all times. Threatening and/or aggressive behaviour will result in immediate termination. No refunds will be payable in this instance.
2.6. Tutor World reserves the right to cancel any session at any time. If this occurs, Tutor World will endeavour to reschedule the session.
3. NON-SOLICITATION
3.1.a The Client is not permitted to enter into any private arrangements whatsoever with any Tutor introduced by Tutor World. Should a Client breach this obligation, they will be liable to account to Tutor World for all sums paid to the Tutor without deduction.
3.1.b A Tutor will be deemed to have been introduced to the Client through either the name of the Tutor being provided to the Client by Tutor World following a request for a tutor, Tutor World arranging a session with the Tutor and Client or Tutor World arranging for a Tutor to contact the Client following a request for a Tutor provided by the Client to Tutor World.
3.2 The Client will not agree any alternative fees with the Tutor.
3.3. These obligations continue beyond the termination or conclusion of this agreement.
4. LIMITATION OF LIABILITY AND INDEMNITY
4.1.a Subject to clause 4.1.b, Tutor World shall not be liable for any claims in contract, tort (including negligence) or otherwise for any loss or damage (whether direct or indirect or arising through implied or express terms) arising out of or related to the use of Tutor World’s services. As a condition of use of this service, Client agrees to indemnify Tutor World from and against any and all liabilities, expenses (including legal fees) and damages arising out of or related to the provision of services by Tutor World.
4.1.b Nothing in this agreement shall exclude or restrict Tutor World’s liability for any liability where the law does not permit such exclusion of liability such as death or personal injury arising from negligence.
5. NO GUARANTEES OF ACADEMIC SUCCESS
5. 1 Tutor World aims to provide the best possible service. However, Tutor World will not be held accountable or responsible for the academic success or lack thereof of a Client. Although we do everything in our power to help grades and skill sets improve, Tutor World can offer no guarantee. Tutor World makes no promises or warranties with regards to a Client’s performance in regards to any or all sessions provided or access to the online platform.
6. DATA PROTECTION
6.1. Tutor World holds and uses client data for the purposes of the services that it provides. Clients providing personal data to Tutor World are consenting to the use of that data by Tutor World for the purpose of effecting introductions to Tutors, for billing and fee collecting purposes and to enable Tutor World to contact the Client.
6.2 The Client agrees that they will not disclose any confidential information concerning the Tutor or Tutor World to any person for the duration of this agreement and for a period of five years after termination of the agreement, save as required by law, court order or any governmental or regulatory authority.
7. PUBLISHED WORK
7.1 Tutor World publishes many of its own original materials. All materials Tutor World creates are copyright. Anyone purchasing any materials (including books), will not publish, distribute or reproduce any portion of any materials without prior written permission from Tutor World.
8. INTELLECTUAL PROPERTY
8.1 All Intellectual Property Rights in or arising out of or in connection with the Services are owned by Tutor World. The Intellectual Property Rights owned by Tutor World cannot be used, modified, copied, distributed, adapted, altered, or in any way exploited, without Tutor World’s written permission. This includes but is not limited to paper class papers, mock exam papers, online platform material, workshop material and all original materials used in sessions.
8.2 The Client acknowledges that all Intellectual Property Rights in
a) all Materials produced by Tutor World for all services shall remain the exclusive property of Tutor World
b) not to use, modify, copy, distribute, adapt, alter, or in any way exploit any material
9. ONLINE SESSIONS
9.1 All of the terms and conditions detailed in this agreement apply to the provision of sessions held online.
9.2 Tutor World will not be held responsible for technological disruption such as a Client’s wifi being down, the online platform malfunctioning or any other event/issue out of Tutor World’s control.
9.3 It is the Client’s responsibility to provide the correct email in order to receive the link to the online session. The Client must ensure they are able to join the session when the link is received. It is not Tutor World’s responsibility to ‘chase up’ if the Client does not join the session.
9.4 Minimum numbers need to be met for group sessions. We reserve the right to reschedule any lessons if this minimum is not met.
10. MOCK EXAMS
10.1 We aim to deliver detailed feedback by email within 2 hours of the exam finishing. However, technical issues may occasionally cause delay. Please contact us if you have not received your child's results within 24 hours.
10.2 Please be ready for the start of the exam, as additional time cannot be given to any student who arrives late.
10.3 Unfortunately, we are unable to give out the question papers after the exam, but students are welcome to go through corrections with our tutors in a separate tuition session.
10.4 Mock Exam bookings can be cancelled up to 2 days before the scheduled mock exam, subject to a cancellation fee of £15 for each mock exam session cancelled. You will be refunded the balance of the price paid minus the cancellation fee to the payment card that you used to make the booking.
10.5 Mock Exam bookings may be amended to an alternative session date, at any time up to 7 days before the date of the exam you have booked. Amendments will incur a £10.00 amendment fee and are subject to availability.
10.6 If there are no suitable alternative mocks exam dates, then we regret that a cancellation of your booking will only be possible if you have made your request at least 2 days before the scheduled mock exam.
10.7 Tutor World reserves the right to cancel a mock exam session, due to circumstances beyond our control, or other reason, and in this event our liability will be limited to the amount you have paid. A full refund will be made in the event of any cancellation made by us.
11. GENERAL
11.1 Tutor World reserves the right to alter these terms and conditions.
11.2 These Terms and Conditions shall prevail over any other Terms of Business or Conditions
11.3 These Terms and Conditions supersede any prior agreement between us relating to their subject matter.
11.4 Nothing contained within this agreement shall constitute the relationship of employer and employee and/or worker or a partnership between Tutor World and the Tutor, or between the Client and the Tutor.
11.5 Any opinion, idea or view expressed by the Tutor is not necessarily an expression of the opinions of Tutor World and should not be held to be so.
11.6 Clients agree to honour the Client Code of Conduct. This is detailed below.
12. LAW
12.1 These Terms and Conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England & Wales.
Client Code of Conduct
Punctuality
The Client must arrive promptly at the time specified.
Attitude
Tutors must be treated with respect. Appropriate language must be used. Swearing, innuendo or offensive language is not tolerated. Aggressive or threatening behaviour will result in immediate termination of the tuition agreement. This applies to both the Client and their Parent/Guardian. Any fees paid for future lessons will be forfeited.
Mobile Phones
The Client must not use their mobile phone during sessions unless specifically told to by a Tutor (for example, if they have taken a picture of a question they would like to go through).
Feedback
In specific circumstances, the Client can receive a small feedback or debriefing session of up to five minutes from the Tutor if requested. If more than 5 minutes is required, the Client must book in a separate feedback session with the Tutor or agree for the Tutor to reduce the teaching time of future sessions to enable them to give the amount of feedback required. If the Client is late, there will be no debriefing session unless given at the discretion of the Tutor.
- “Client”: the recipient of the session/access to the online platform.
- “Tutor”: the person/s providing the session for the Client
- “Session”: the period of time during which a Tutor is engaged and working with a Client. These include group tuition, one-to-one tuition, paperclasses, workshops, seminars and mock exams.
- “Tutor World”/’We’: Tutor World Education Ltd
- “Services” means all those services provided by Tutor World. These include but are not limited to the Website, the content contained therein, sessions, the online centre.
